Vitamin Well LLC (the “Company”) values your privacy and is committed to protecting your privacy. The company will process your personal data in accordance with our Privacy PolicyCalifornia Personal Privacy, and our Terms of Use.  

This SMS privacy policy (“SMS Privacy Policy”), together with our Privacy Policy, governs how the company process personal data collected and received from you in connection with your use of the SMS service (the “Service”), which the company makes available to you through a third-party service provider. This SMS Privacy Policy is incorporated into the Terms of Service (found below).

You agree to the terms of this SMS Privacy Policy by using the Service. The company reserves the right to, in its sole discretion, modify or change the SMS Privacy Policy at any time with or without prior notice to you. The SMS Privacy Policy, and any changes, are effective as soon as they are publicized and posted. If you continue to use the Service after the implementation and posting of any changes to the SMS Privacy Policy, you will be deemed to have fully accepted those changes.  

Personal data is information that identifies you, directly or indirectly, such as your mobile phone number or user/screen name, including any other personal data you choose to include in messages you send through the Service. 

What personal data is collected about you 

The company will collect the following data from our third-party service provider by the use of the Service: your mobile phone number, the text messages that you send using the Service, any user or screen name that you select in connection with the Service, date and time, location (both physical location and web location of opt-in), and any comments or feedback regarding the Service that you send to the company. 

How the company processes data collected through the use of the Service 

Personal data is processed by the company through the use of the Service to: (a) provide you with the Service, (b) process and respond to inquiries, (c) improve the Service, (d) conduct market and advertisement campaigns and (e) contact you with important announcements or messages.  

Each message that you send through the Service is stored on servers provided by a third party and the company retain these messages on such servers. The company utilizes servers and services owned by third parties. 

Disclosure of Your Information 

When a business sells your personal information, you have a right to opt out of such sale. The Company does not sell information as the term “sell” is traditionally understood. However, the Company may disclose certain information about you when you use the Service for purposes that may be considered a “sale” under the CCPA. For example, the Company may disclose information to advertising partners, advertising technology companies, and companies that perform advertising-related services in order to provide you with more relevant advertising tailored to your interests. To the extent the Company sells your personal information as the term “sell” is defined under the CCPA, you have the right to opt-out of the sale of your personal information by us to third parties at any time. Opting Out 

The company’s third-party service provider gives you the ability to opt out of the Service for any reason. You can opt out by texting “STOP” to +16052504411. 

Children 

The Service is not directed to nor intended for children under 13, and the company does not knowingly collect information from children under the age of 13. 

By using the Service, you are representing and confirming that you are at least 18, or that you are at least 13 years old and have your parents’ or your legal guardian’s permission to use the Service. Children under the age of 18 and aged 13 or older should not submit any personal information without the permission of their parents or legal guardians. 

Intended Audience 

The company requires that users of this service be limited to US residents only.

TERMS OF SERVICE 

The Service is operated by ManyChat, Inc. (“ManyChat”). Your use of the Service constitutes your agreement to these terms and conditions (“Terms of Service”).  

The company does not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. 

Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Service provides promotions, specials, and other marketing offers from via text messages through your wireless provider to the mobile number you provided. Message frequency varies. Text the single keyword command STOP to +16052504411 to cancel at any time. You will receive a one-time opt-out confirmation text message. 

The company may change any short code or telephone number the company uses to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number the company has changed may not be received and the company will not be responsible for honoring requests made in such messages. 

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages.  

You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from your use of the Service or from you providing us with a phone number that is not your own. 

To the extent permitted by applicable law, you agree that the company will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
